Anders Bouviers Guarantee and Sales Contract

This is a guarantee and sales contract between Margret Nolan, Anders Bouviers and the buyer ________________________ regarding the sale of a (fe)male Bouvier des Flandres puppy from a litter born on: ________________________

to SIRE: ______________________ 

AKC # __________________

and DAM: ________________________

AKC # __________________.

 This purebred puppy can be registered with the AKC as (full registration) (non-breeding registration) until such time as appropriate health tests are passed at two years of age regarding hips, heart and eyes.

The sale price of this puppy is $1,500.00 (fifteen hundred dollars) and includes ear cropping.

This animal is guaranteed to be free of debilitating hereditary crippling defects which would cause it to be unsuitable as a family companion up to the age of two years. Determination of what constitutes a hereditary defect is to be by the unanimous agreement of two (2) veterinarians agreeable to both parties. One of these veterinarians is to be a tenured faculty member of an accredited university veterinary teaching hospital or Board Certified in the applicable specialty. Cost of the opinions are to be assumed by the buyer. Medical reports of the dog's condition must be provided to the buyer; the owner's opinion that the dog has a defect is not adequate. 

 If the dog is found to have hereditary crippling defects at or before one year, seller has the option of refunding 100% of the original purchase price of the dog, not to include shipping or other ancillary costs, or providing the buyer with the next like available prospect or mutually agreeable animals , providing (s)he hasn’t been bred and has been cared for responsibly and lovingly according to conditions below listed under care. , the original dog will remain in the possession of the buyer.

The health conditions are: crippling hip dysplasia not caused by trauma and without the presence of obesity, SAS, primary glaucoma. (Buyer) agrees to return the dog to Margret Nolan, Anders Bouviers if buyer cannot keep (she)he for any reason whatsoever.

This dog is guaranteed to be of good temperament at time of sale.

Buyer agrees to: Annual veterinary checkups, keeping all immunizations current according to AVMA guidelines; (S)he will at no time be permitted to become overweight and will be kept on heartworm preventative and provided with all necessary shots and wormings, buyer agrees to provide adequate housing according to state law; to confine the dog in a fenced yard or kennel run, or walk on a leash but not restrain (tie-out) on a rope or chain.

If the dog is considered “dangerous” or “vicious” or has bitten, and the owner will not keep the dog, Seller must be given the choice to take back the dog to prevent euthanasia so long as such action is not in violation of any law. If buyer is having problems with the dog, buyer will attempt to resolve these with Margret Nolan, Anders Bouviers before the dog’s transfer could become a violation of law. If buyer changes residence or phone, she will promptly inform Margret Nolan, Anders Bouviers of such change.

This pup will be named with the “Anders” prefix and a name beginning with the letter “__”.

For this sales agreement/health guarantee to stay in effect, the dog/bitch must be taken to a veterinarian of the buyer's choice and at the buyer's expense within 5 days of the date of sale for a health check. A signed statement from the veterinarian concerning the Bouvier's condition must reach the seller within 7 days of the examination and must be sent in a method that requires a signature when delivered as proof of time of delivery and proof of person receiving the letter containing the document. Failure to do so will cancel this entire contract and relieve the seller of all liability.

Buyer agrees to enroll and attend no fewer than two complete obedience classes with this dog before the dog is two years old.

 If the buyer wishes to return the dog at any time within six months from the date of it's sale, the seller will refund the purchase price of the puppy minus any out of pocket costs associated with re-homing the puppy if the puppy is brought back with all health records and AKC registration papers and only after Margret Nolan, Anders Bouviers places the dog in a new home.

If buyer changes residence or phone, she will promptly inform Margret Nolan, Anders Bouviers of such change

At any time during the lifetime of this Bouvier, the buyer decides to sell or otherwise dispose of this dog, Margret Nolan, Anders Bouviers must be informed and always retains the right of first refusal. If the dog is considered “dangerous” or “vicious” or has bitten, and the owner will not keep the dog, Margret Nolan, Anders Bouviers must be given the choice to take back the dog to prevent euthanasia so long as such action is not in violation of any law. If buyer is having problems with the dog, buyer will attempt to resolve these with Margret Nolan, Anders Bouviers before the dog’s transfer could become a violation of law.

Failure to enroll and attend no fewer than one complete obedience classes before this dog is one year old voids all guarantees.

The breeder will be welcome to visit with reasonable notice and will keep in touch about the progress of training. Her support will be sought for any problems as soon as they arise. This contract is considered legally binding by both parties. Any changes to this agreement will only be binding if made in writing and signed by both parties.  

SHIPPED PUPPIES

For all buyers that are having their puppy shipped by airfreight, whether you live in-state, out-of-state or out-of-country, we take your puppy to a licensed Vet (at the seller's expense) and send the puppy with an official Health Certificate. We do this for three reasons: (1) It is a requirement of all airlines to ship live-animals out of state or out of country; (2) we feel this is the least we can do since you decided to make a long distance purchase from our kennel; and (3) this prevents all allegations that a dog or puppy was sick when it left our kennels and thus the health certificate is the health guarantee for your puppy if shipped by airfreight.

No other guarantees, assumed or implied are covered by this contract.

FAQ

Shipping? We can have your puppy fly from either Tampa or Orlando International Airports. Shipping costs vary depending on the size of the crate the pup is shipped in but generally run about $200 in the continental U.S. for 8 week old puppies.

Stress? Any time a puppy is taken from it's environment, mother, siblings and original people, it undergoes stress. Keep your pup quiet and isolated from large gatherings of people for the first week or so.

Vaccinations? We vaccinate beginning at 5 weeks for Distemper, Hepatitis, Leptospirosis, Parainfluenza and Parvovirus and routinely wormed. You will want to be aware that there is quite a bit of discussion in the dog breeding community about the vaccinating puppies and it's relationship to auto-immune disease.
